QUESTION # 3 (Email attachments not included for security purposes) ED LOWREY ANSWER: "Don't ask questions you don't want answers to......As a
Deputy, if I stop you for say a tail light out and you let me know you are
packing a gun and have a permit, I will check it. As a Tennessee
resident you are permitted to have a non resident Florida permit. If
I found you to have a Tennessee Drivers license and a Florida non resident
handgun permit, I would thank you for your time and send you on your way.
There is no TCA which requires you to give up a non resident permit from
another state if you have a Tennessee permit. You only have to give
it up if you have the resident permit, as most do. You may however, have
to change your address on file with Florida. I possess a non
resident Nevada and Hew Hampshire permit as well as a Tennessee resident
handgun permit. When you ask a question of the Tennessee Department of
Safety you should expect a politically correct, cover your butt, but sadly
not very informed answer. You don't call the IRS to ask if that
deduction you want to take is correct, you go to H&R Block. They
answered the question based on the correct response for Drivers License
and Resident gun permits. Once you change your residency to
Tennessee you are required to get a TN drivers License and if you want to
carry a gun in TN, a TN carry permit because you are no longer a resident
of the previous state which issued you a gun permit. The permit is
no longer valid....unless it is one of the Non Resident permits which are
not based on your state of residence. Simply get your TN Drivers
license and keep your Florida non residence permit (please make sure you
actually have a NON RESIDENT Permit and not a Resident Permit but you are
calling it a non resident because you moved.) This is absolutely no
different from any long time Tennessee resident who goes to the trouble of
getting a Florida Non Resident CCW and carries in TN. Until the
State Attorney General makes a decision that Tennessee will not accept
Florida Non Resident permits, then you are OK. I would however,
consider taking the TN course to upgrade your knowledge of our unique laws
and apply for your TN permit.....just don't say anything about your
Florida Non Resident license. You would then have more state to
travel in. Those reciprocal with Florida and with TN. Don't
ask questions you don't want answers to, especially of state bureaucrats.
Of course that is just my opinion." If you want to post a comment on this question or answer, send it to: Please put Ed Lowrey #3 in the subject line of your e-mail. After making sure there is nothing offensive in the e-mail, it will be posted here. Please include your name and state. © 2006
