Murder Trial For
Tennessee Permit Holder Set To Begin On Aug. 17th 2002
This menace to society had
attacked a female with a knife in her own store. He was in the process of dragging
her to the back of her florist shop for who knows what, when a neighbor came to her
rescue. The attacker fled with the money he took, and ran down the street. The
good Samaritan arrives and the woman tells him what happened, and the man still has her
money.
The neighbor gets into his
vehicle, locates the man and yells for him to stop. The attacker turns, produces the
same knife he held to the woman's throat, and tells the good Samaritan what he is going to
do to him with the knife. He then advances towards the good Samaritan. The
good Samaritan draws a small caliber pistol from his pocket, and tells the attacker to
stop and not advance any further. The man continues his advance. One shot
fired, the good Samaritan stumbles, as he regains his footing, he sees that the attacker
is closer. He fires again. The attacker falls mortally wounded next to the
good Samaritans vehicle.
Justifiable Shooting?
Most people would say yes.
Not according to the District Attorney's Office in Nashville. Wayne Martin
was arrested and charged with 2nd degree murder for the above incident. For those of

If You Carry A Gun, This Could Happen To You
This type of incident
could happen to anyone who legally carries a weapon. Civil and criminal liability is
just something that goes along with carrying a gun. However, in this case it seems
that a point is trying to be made about not chasing a fleeing felon. In some states
it is permissible to chase a fleeing felon, but in Tennessee it is not.
